Sponsor introduces RS to move Idaho Department of Labor rules into statute for clarity

Representative Laurie McCann told the Commerce and Human Resources Committee she is introducing an RS that incorporates numerous existing IDAPA rules into the employment security statute to improve readability and centralize related requirements.
McCann said the changes are a response to 2024 legislation—House Bill 563, which directed agencies to evaluate moving rules into statute when beneficial, and House Bill 626, which changed how courts interpret agency rules. "We have asked our agencies to review their rules, and we've asked them to see what can be moved, if it is appropriate, moved to statute," McCann said. She described moving roughly 32 pages of rules into statute, combining some provisions and deleting others, but said the intent is not to change program operations: "They are just being incorporated within the statutes."
The RS restructures Title 72 employment-security provisions by creating six new sections and amending 24 other sections, according to McCann. She described moving portions of IDAPA rules on administrative procedure and disclosure of employment-security information into statutory language and folding unemployment-insurance administration rules into the statutory chapter.
Committee members did not ask substantive follow-up at the RS stage, and the motion to introduce RS 31830 passed by voice vote. The RS will go to public hearing where stakeholders can review the draft statutory language and raise concerns or suggest technical edits.
