Committee approves plain-language updates to cigarette and tobacco rules; no material changes reported

Elena Gonzalez, tax research specialist at the Idaho State Tax Commission, presented docket 35-0110-2401, describing a comprehensive review and update of the cigarette and tobacco rule chapters under the Governor's zero-based regulation executive order.

"This is a complete review and update of the cigarette and tobacco rules in compliance with Governor's 0 Base Regulation Executive Order 2020-01," Elena Gonzalez said, adding that the process sought public input and consolidated sections that applied to both cigarette and tobacco products.

Gonzalez said the changes remove text that restates statute and eliminate examples from the rule chapter; when appropriate, examples were moved to the Tax Commission website. She said there were no material or substantive changes to the tax treatment; the edits were intended to simplify and use plain language for better understanding.

Senator Riggs and other members asked procedural questions. Senator Taylor raised questions about the destruction of stamps and tobacco products: Gonzalez said the Tax Commission reserves the right to witness destruction, requires prior permission before destruction occurs and will verify that items are destroyed; she offered to follow up with details on how destruction is carried out.

Senator Den Hartog moved approval of docket 35-0110-2401 and Senator Taylor seconded; the committee approved the docket by voice vote. Gonzalez said the department published notices, held two meetings, received no objections and engaged industry representatives during the process.

The committee approved the plain-language and consolidation edits without substantive policy changes in committee testimony.
