Committee approves bill moving mental-health and substance-use rules into Idaho code

Senators on the Health and Welfare Committee voted to send Senate Bill 1024 to the Senate floor with a due-pass recommendation after the sponsor described the measure as a technical move to place administrative rule text into statute.
Nut Graf: Senator Julie Van Orden told the committee SB1024 transfers three sets of administrative rules — covering children's mental-health services, substance-use disorder services and adult mental-health services — from agency rule into Idaho Code (chapter 31, title 39). She said the bill does not increase or decrease services but codifies definitions and eligibility screening requirements in statute.
"We're taking that part of administrative rule and applying it to the code where it's addressed in code," Senator Julie Van Orden said. She explained the first two sections move children’s definitions and eligibility screening requirements and the last moves three sections for adult mental-health services into code. She said the bill also repeals the three rules that were set to take effect July 1 and replaces them with statute effective the same day.
The committee recorded no public opposition during the hearing. After brief discussion, Senator Blaylock moved to send the bill to the floor with a due-pass recommendation; Senator Lehi seconded the motion and the committee approved it.
Action: Committee voted to report SB1024 to the floor with a due-pass recommendation.
