Lloyd Knight, deputy director of the Idaho State Department of Agriculture, said the temporary rule provides the procedural framework needed to accept and process producer claims that were submitted by the December 31 statutory deadline. Knight told the committee that the department has been reviewing the claims and expected to determine reimbursement decisions within days to weeks. Because negotiated rule‑making was not completed in time, the department used a temporary rule to allow prompt implementation and has committed to conducting full negotiated rule‑making and broader stakeholder engagement during the next rule‑making cycle to refine procedures.
The committee moved and approved the temporary rule by voice vote. The temporary rule enables the department to make reimbursements under existing statutory authority; the department will return to negotiated rule‑making for a permanent rule to ensure broader stakeholder input.
