The Boulder County Board of Commissioners voted Jan. 9 to approve community planning and permitting docket LU24‑0016, allowing a 602‑square‑foot family‑care accessory dwelling unit (ADU) at 1005 Cherryvale Road.
Staff review and recommendation: Sam Walker, the reviewing planner with the Community Planning and Permitting Department, told the board the parcel is zoned Rural Residential, is a little over one‑half acre, and already contains a primary 1,359‑square‑foot residence plus a 1,440‑square‑foot tool shed. The proposed detached ADU would be 602 square feet with a height shown as 14 feet, 6 inches and would be slab‑on‑grade. Staff found the proposal met the county’s limited‑impact special‑use standards for a Family Care Unit ADU and recommended conditional approval, subject to permitting and minor plan revisions for pedestrian access and drainage swales.
Applicant testimony: Renee Galobich, representing property owners Dennis and Melanie Klein, said the unit is intended to house Melanie’s mother, Anita Goldberg, to allow closer family care and maintain the couple’s small farm business, Sunbeam Farm and Education LLC. Dennis Klein described Anita’s health limitations and said the ADU was designed with an ADA‑accessible bathroom and no‑step entry to support day‑to‑day needs. “Anita… she’s the most kind and loving person you’ll ever meet,” Dennis Klein said, describing the family’s purpose for the unit.
Legal advice and post‑hearing procedure: Commissioners briefly moved into an executive session under the statute cited on the record for legal advice; they returned to the public hearing and asked no further questions of staff or the applicants.
Vote and conditions: Commissioner discussion endorsed staff analysis. A motion to approve LU24‑0016 with staff’s recommended conditions carried unanimously. The approval included conditions to (1) permit and/or regularize the two unpermitted structures on the parcel, (2) provide a setback survey at permitting so the ADU will be located outside of the 90‑foot supplemental setback along Cherryvale Road, and (3) revise building‑permit plans to show pedestrian access and address drainage swales per Access and Engineering referral recommendations.
