Auto Works Inc. withdraws request to amend special permit; council grants leave to withdraw with prejudice

Attorney James Giuliano told the Woburn City Council on Jan. 21 that his client, Auto Works Inc., will withdraw a petition seeking an amendment to a special permit issued May 27, 2021.
Giuliano said the withdrawal is linked to a Land Court settlement agreement that requires the matter to be returned to the council and that, upon withdrawal by the petitioner, the Land Court appeal will be dismissed. He described the proposed withdrawal as being “with prejudice,” meaning the applicant would not refile in the near term.
The council received a written communication dated Jan. 16, 2025 from Attorney Thomas A. Mullen and accepted it into the record. After opening and closing a public hearing with no commenters, the council voted by roll call to grant Auto Works leave to withdraw the application with prejudice; the motion passed on a unanimous voice/roll call vote.
The council also accepted the communication from Giuliano’s office into the permanent record. No member of the public addressed the council on the item during the hearing.
Because the petitioner is withdrawing with prejudice in line with the Land Court stipulation, Giuliano said the related Land Court appeal will be dismissed after the council’s action. The council’s vote ends the pending request before the city; any future filing would be subject to statutory and local filing rules.
