Applicant requests change to stipulation; Wolf Creek driving-range conditional use permit remanded to zoning board for reconsideration
Summary
Planning staff told commissioners that the applicant for a conditional use permit for a driving range at the Wolf Creek property requested a change to a demolition stipulation; because any change to CUP stipulations requires zoning-board reconsideration, staff said the case must be remanded to the zoning board.

Planning staff told the Board of County Commissioners on Jan. 30 that an application for a conditional use permit for a driving range at the Wolf Creek private golf course must be remanded to the zoning board after the applicant requested a change to a stipulation about demolition of an on-site house and barn.
Why it matters: The applicant seeks to operate a driving range with a 4,300-square-foot heating/heading shed on roughly 43 acres; the change affects whether two structures used by maintenance workers would be demolished. Because planning staff and the zoning board consider stipulations part of the approval record, any post-hearing change requires reconsideration by the zoning board.
Planning summary and recommendation: Planner Zoe Brown said the CUP request included a five-year term and that the applicant asked to amend stipulation No. 4 to allow retention of a house and barn currently used by maintenance staff. "Staff supports making the change, and this was not an issue brought up by either the public or the zoning board members at the meeting," Brown said. "However, any changes to the CUP stipulations require reconsideration by the zoning board. Therefore, the application must be remanded to the zoning board and reconsidered before it's approved by the BOCC."
Public input and next steps: Commissioner Brewer said residents raised concerns at the East Zoning Board meeting but that developers agreed to additional landscaping and screening, which satisfied zoning board members and led to a unanimous recommendation. The BOCC did not take a final action during agenda review and directed staff to remand the case for the zoning board to reconsider the requested stipulation change.
Ending: The project will return to the zoning board for reconsideration and then, if recommended, will come back to the BOCC for final action.
