Court delays decision on City Springs Road relocation engineering to consult procurement counsel

Gilliam County road staff briefed the court on proposals received in response to an RFP for engineering services to support the City Springs Road relocation project and the court agreed to defer awarding the contract pending legal review of procurement and fee‑structure options.
Roadmaster Dewey Kennedy said the county received two proposals—Anderson Perry and Henderson Engineers—and that evaluation showed both firms qualified. He told the court Anderson Perry provided a clearer schedule for delivery, including a notice to proceed in February and a final design package in September. Kennedy said the major cost uncertainties relate to environmental issues, wetlands and potential mitigation rather than basic engineering tasks, and that he used a $500,000 estimate in the county budget for the engineering phase while the total project was budgeted at about $3.2 million.
Several commissioners asked whether the county could obtain a not‑to‑exceed amount or phase‑based cost caps so the county knows the maximum exposure before awarding the RFP. One commissioner requested procurement counsel be consulted on whether the county can structure the contract with discrete phases (environmental, survey, design) with not‑to‑exceed amounts for each phase.
The court directed staff to consult the county’s procurement/ legal counsel and return with guidance and recommended contract language to allow awarding the work while limiting financial exposure. The item was put on the Feb. 5 agenda for final decision.
