Commission reaffirms land-development approval for Birch/Burn Street car wash project

The Planning Commission on Jan. 28 reaffirmed a previously approved land-development plan for the Birch/Burn Street car wash (applicant and staff used different spoken spellings in the meeting record), subject to satisfaction of the Hawk Valley review letter dated Jan. 17, 2024, and final municipal-improvement and stormwater-maintenance agreements.
Planning staff said the applicant had resolved prior outstanding review-fee issues and had submitted revised stormwater reports and responses dated Jan. 25, 2024. Representatives for the applicant said most comments had been addressed, that stormwater calculations and reports had been previously submitted, and that they would provide any outstanding documentation to staff. Public Works and planning staff noted one remaining item: sidewalk replacement along North 5th Street and whether adjacent curb replacement or a Highway Occupancy Permit (HOP) from PennDOT would be required because North 5th is a state highway. Staff said they would review file records and follow up.
Commissioners moved, seconded and voted to reaffirm the plan with the condition that items in the Hawk Valley review letter of Jan. 17, 2024 be met to the approval of staff.
