Committee takes grievance over RNC overtime under advisement after closed session

The Green Bay Personnel Committee considered a grievance filed by the Green Bay Professional Police Association alleging a contract violation over overtime pay for officers who worked at the Republican National Convention (RNC). City attorney Jeffrey Lacy framed the city's position, saying the chief “had full authority to decide whether or not to provide that assistance or not and full authority to withdraw the decision to provide that assistance,” and that the city attempted to make the deployment revenue neutral because the city could not confirm Milwaukee or grant funding would reimburse certain overtime costs.
Association representatives said they believed the contract does not distinguish between an off day and vacation for overtime allocation and cited past practice. Detective Scanlon argued the contract “does not distinguish between an off day and an on day” and that overtime allocation has been administered by seniority in past practice for comparable events.
Materials entered into the record included the grievance form (grievance no. 24‑001 dated Nov. 25, 2024), interdepartmental correspondence and step responses from the chief and the chief of operations (dated Sept. 17 and Nov. 11, 2024), a reply from attorney Jonathan Cermelli (Nov. 21, 2024), and a city position statement by attorney Jeffrey Lacy opposing the grievance. The committee noted section 3.8.0.3 of the labor agreement and the usual grievance/arbitration process for disputes.
After taking questions in open session, the committee voted to convene in closed session under Wisconsin Statutes (recorded by staff as “19.85 IA” and referencing the closed-session statute) to deliberate. In closed session the committee deliberated and then returned to open session and voted unanimously to take the grievance under advisement and to issue a written decision with findings of fact and conclusions of law at the next regular personnel-committee meeting.
No final decision on the merits was announced at the meeting; the committee’s action postpones a ruling until the next meeting, when the committee will issue written findings and a decision.
