The Board of Zoning and Adjustments of Decatur City approved an appeal to allow a private residence to be built on a parcel that is partially zoned B-2 General Business, conditioning approval on compliance with subdivision rules and successful annexation, rezoning and consolidation of parcels.
Applicant Dylan Pate sought permission to build his personal residence on a currently vacant parcel identified in the record by partial ID 27375 on Pisgah Road. Richard Humphrey, representing the applicant, said the lot splits the municipal zoning line and that the proposed house would sit partially within the B-2 zone and partially outside the city’s annexed area.
Board members and the applicant discussed logistics. The applicant said he planned to tie into an existing sewer line and that consolidation and annexation filings had been submitted for the Planning Commission agenda. Planning staff advised the board that conditions should require compliance with subdivision regulations and that annexation and consolidation be completed. The motion the board approved specified that the proposed building must meet all subdivision regulations and that the parcels be annexed, rezoned and consolidated as part of the conditions for approval.
The board recorded a favorable vote on the conditioned approval. Board members noted that even if the board approved the appeal, the applicant or future owner could alter the house placement to fit entirely within the B-2 portion of the lot; final layout and permitting remain subject to Planning Commission and building-department review.
