Defense counsel Michael De Leon told the court the parties had reviewed the pre-sentence investigation and argued mitigation; the defense urged consideration of Herrera’s acceptance of responsibility. The judge said she reviewed the PSR and relied on the stipulations in the report in reaching her ruling. The court explicitly told Herrera that, because the plea was followed and a waiver of appeal was signed, he did not have the court’s permission to appeal the sentence and reminded him of post-conviction restrictions related to weapons.
The judge also advised Herrera about registration obligations and warned that failing to register would be a separate offense. No additional sentencing reductions or alternatives were adopted on the record.
