Commission accepts Harbor at Lake Henry infrastructure and releases developer performance bond

The Winter Haven City Commission on Jan. 27 approved Resolution R-25-04 to accept public improvements and dedications for the Harbor at Lake Henry subdivision and to authorize release of the developer’s performance bond.
Staff said the subdivision covers about 36.03 acres south of the east intersection of Old Lucerne Park Road and Lucerne Park Road (State Road 544), contains 179 building lots and 14 common lots, and that water and sewer lines and internal roadways will be owned and maintained by the city while stormwater infrastructure will be maintained by the homeowners association.
Why it matters: The developer had posted a performance bond of $313,258 to guarantee completion of required earthworks, sanitary sewer, potable water, stormwater management and engineering certification. Staff said recent inspections found the previously incomplete improvements to be complete, so staff recommended acceptance and release of the bond.
Related transportation context: Staff and the city’s economic director said updated traffic information from the Polk TPO shows increasing traffic on Lucerne Park Road and that planned FDOT corridor improvements include signalization and a roundabout at certain intersections; staff said capacity will be sufficient for Harbor at Lake Henry and the Willowbrook North subdivision until capacity is used up further down the corridor.
Public comment: Ernestine Davis, a nearby resident, asked about the location and timing of the signal/roundabout and expressed concern about safety at the intersection; staff clarified that the signal is an FDOT project and described the specific easternmost reconnection of Old Lucerne Park Road with Lucerne Park Road as the location discussed.
Vote and next steps: After a public hearing with comments, the commission approved Resolution R-25-04. The city manager was authorized to finalize the administrative acceptance and release the performance bond.
