The Senate Human Services Committee on Jan. 15 adopted an amendment to Senate Bill 2164 that clarifies how banks should respond to information requests from Protection and Advocacy (P&A) entities and then voted to pass the bill as amended.
Committee members said the amendment resolves an interpretation dispute between P&A and several banks about whether newly issued bank guidance made P&A requests fall outside banks' obligations. "Banks got new guidelines on how to release information," a committee member said during the discussion, adding that banks and P&A negotiated wording so financial institutions would not be treated as having a legal obligation to investigate P&A reports. The committee described the change as a "minor tweak in the law."
