The Brazos River Authority Board of Directors on Jan. 27 authorized the general manager to finalize and execute an interlocal and contractual agreement dedicating 6,035 acre-feet of BRA water per year to the Texas Parks and Wildlife Department for in‑stream uses along the Brazos River main stem downstream of Possum Kingdom Lake.
Staff counsel Destiny Rasch Huber told the board the dedication “is about 20 years in the making,” tracing to a 2011 memorandum of understanding with TPWD tied to BRA’s system‑operations permit and the agency’s water‑management plan. The donation was incorporated into BRA’s technical modeling during the permit process and was included in the water‑management plan that supported the authority’s system‑operations permit.
Rasch Huber said TPWD had accepted the dedication and that legal staff were finalizing both the interlocal and the contractual agreement. She said the documents must be completed and signed by March 2025 to meet scheduling for BRA’s upcoming water‑management plan update.
Directors asked for clearer wording in the resolution to avoid implying the donation comes only from Possum Kingdom Lake. Director Jen (first name not recorded) suggested amending the text to read “for use in the stream segment from Possum Kingdom Lake to the Gulf of America,” and staff agreed to return with the clarified language. Board members pressed staff to ensure the agreement will operate under BRA’s drought contingency and accounting rules and to require coordination and reporting from TPWD about how the dedication is used in any given year.
In the discussion, staff said the dedication is not new water to be withdrawn from other customers; rather, it comes from water that BRA set aside or modeled as part of its system‑operations permit. Aaron (water services staff) explained that the donation could be used at multiple reaches along the main stem and that flows would remain in the stream — TPWD would not be allowed to divert the donated water for off‑stream use.
The board approved the resolution after staff revised the text to clarify the stream segment language. The resolution authorizes the general manager/CEO to finalize and execute the interlocal and contract dedicating 6,035 acre‑feet per year to TPWD for in‑stream purposes.
