Board approves special exception for tire shop on Veterans Memorial Parkway with requirement that tires and work be kept inside

The Zoning Board of Adjustments on Jan. 27 granted a special exception for a new and used tire shop at 21100 Veterans Memorial Parkway, finding the use fits the city’s light vehicle repair rules and imposing conditions to keep storage and repair activities inside the building.

City planning staff presented images of the property and cited section 25-101 of the city’s updated zoning code, which outlines criteria for light vehicle repair uses. Staff said the applicant represented that all tires would be stored inside, that the business would not perform mechanical work beyond mounting and balancing and that operations would be Monday–Saturday, 7:30 a.m.–5:30 p.m. Staff reported two written public comments in opposition.

The applicant, who identified herself at the hearing as Eula Domingo, described plans to use the site’s two roll-up bays to mount and balance tires and to keep inventory primarily in off-site storage, bringing tires to the site as needed. Asked whether work would be done outside under an awning, Domingo said the plan was to perform mounting and balancing inside the building: “the machines will be inside the building. So they would have to take the tires inside… mount it and balance, bring it back, and then put it back in the car.”

Board members asked about storage and outdoor activity. Planning staff emphasized the code language that “repair equipment shall be entirely enclosed within a building” and that no outdoor storage of tires is permitted. Board member Joseph Eadman said the site is appropriate for an automotive use and noted prior uses at the location; other members said they would monitor compliance with the code and community character.

The chair read the motion to approve ZBA-02-25, Eula Domingo’s petition for a special exception to operate a light vehicle repair store (tire shop) at 21100 Veterans Memorial Parkway, zone GC, Council District 5. The board voted to approve the special exception with the understanding that tire storage and repair equipment must be kept inside the building and that any change of use would require a new special exception.

Staff advised the board that enforcement of the zoning condition does not substitute for private covenants or HOA rules; if tires or activity occur outside the building, the city may require compliance with the code and the petitioner could be subject to enforcement action.
