The commission’s approval was conditioned on several standard staff items, including submission of a revised landscape plan to meet perimeter landscaping requirements and a lighting/photometric plan prior to permitting.
Why it matters: The lot was previously used to provide parking for the multi‑tenant building on Lot 1; the new building will occupy part of that lot but retain 58 existing spaces, and the combined parking supply between the two lots will exceed the town’s most restrictive parking calculation for the combined uses. The Board of Zoning Appeals granted a special exception for the drive‑through pickup window; the BZA required that any future on‑site ordering equipment or menu boards would need additional BZA review.

Petitioner comments: William Wilson of Paragon Realty (owner/developer) and the project team said they will record a cross‑access and maintenance declaration between Lot 1 and Lot 2 so the two parcels function together even if ownership changes. Paragon also said it upgraded lighting across Lot 1 in 2023 to LED and will provide a photometric/lighting plan for the new lot.
Commission action: The commission found the project met the UDO’s architectural and parking standards after the requested adjustments and approved DPR 2419 subject to the staff conditions listed in the report (revised landscape plan and lighting review among them). The drive‑through pickup window was previously approved by the Board of Zoning Appeals with a condition limiting future on‑site ordering.
