Jeff (city staff) told the council, "The effort on the green lot is progressing well. We have provided the developer with drafts of the development agreement and a draft of a purchase agreement." He said the extension reflects extra time needed to work through logistics around displaced parking and to identify solutions before finalizing the development agreement.
The extension discussed at the study session does not itself change the original business terms of the deal, staff said. Jeff told the council the development agreement will include an exhibit called a construction mitigation plan that will spell out solutions the developer and the city will put in place during construction to reduce disruption for nearby businesses and customers.
Council member Spilsbury asked, "At what point will this come back to us for any thing?" Jeff answered that staff is targeting bringing the development agreement back to the council in the next two to three months.
Jeff said staff recently met with Chuck Linton and an individual identified as Amanda to check that city and business understandings align with the developer’s plans. Council members emphasized keeping nearby businesses and parking access working during construction.
No final development agreement was approved at the Jan. 27 study session; staff characterized the item discussed as an extension of an existing memorandum of understanding and said formal agreement documents will return to the council for future action. The study-session discussion also included a commitment from staff to highlight the construction mitigation solutions when the full development agreement is presented to the council.
Next steps: staff will continue coordination with the developer and adjacent businesses, finalize the construction mitigation exhibit, and return a proposed development agreement to the council within an expected two-to-three-month window.
