Tabitha Haygood of Fitz and Shipment, representing property owner Mark Fertitta, asked the Planning Commission and City Council to approve a replat of Tuscany Park phases 1 and 2 to create four commercial lots and to record an access easement across the center of the commercial tract.
Staff told the commission that the proposed replat "meets the city's minimum subdivision requirements" and recommended approval with one condition: the new lots must "adhere to the utility easement requirements of CenterPoint Energy to lots 1a, 2a, and 3a." Staff also reported that 29 property owner notices were mailed, and the city received two in favor and none in opposition.
No members of the public spoke against the replat at the hearing. With no applicant representative in the audience, the commission opened the public hearing, heard staff's presentation and condition, and then considered a motion. A commissioner moved approval "with condition number 1." The motion carried on a voice vote; the chair declared "the ayes have it." The record indicates no opposition was registered at the hearing.
The commission's action clears the replat to record once the stated CenterPoint Energy easement requirement is satisfied. The staff recommendation and the single condition remain part of the project record.
The replat and condition will be reflected in the final plat documents to be recorded by the applicant or property owner.
