Planning commission approves replat of Tuscany Park commercial center with easement condition

Planning Commission Chair Sina Nejad said the commission approved a replat of Tuscany Park on Jan. 27 that will convert the existing common area and Lots 1–3 into four commercial lots and record an access easement across the commercial center.
The action, sought by Tabitha Haygood of Fits and Shipman on behalf of property owner Mark Fertitta, was approved with one condition. "Staff recommends approval of the request with the following condition, shall adhere to the utility easement requirements of CenterPoint Energy to lots 1 a, 2 a, and 3 a," Haygood told the commission during the staff presentation.
The replat covers property in the Hezekiah Williams Senior League survey within Tuscany Park. Staff said the proposal meets the city's minimum subdivision requirements and noted that 29 property-owner notices were sent; two responses supporting the replat were received and none opposed. The staff presentation included an aerial image and a plat showing the area to be platted and the access easement that will be recorded across the commercial center.
No members of the public spoke for or against the item at the public hearing, and the commission moved to approve the replat with the single staff condition. Chair Nejad called for the motion and the commissioners voiced assent; the motion carried.
The condition requires the applicant to comply with CenterPoint Energy utility-easement standards for Lots 1a–3a before final plat recordation. The staff packet and presentation described frontage-along-easement rules for commercial lots in planned commercial centers and noted the easement must be "permanently accessible to the public and designed and constructed" to the commission's approval.
The applicant was not present for the hearing but the engineer of record attended. The commission's approval allows the applicant to record the replat and access easement consistent with the condition; subsequent implementation steps include final plat recordation and any required permits or construction approvals for access improvements.
Votes at the meeting were taken verbally during the planning commission session and recorded by the chair.
