Nicholas Zubares, the petitioner, told the council, “We're not gonna touch anything in there. We're just gonna add a pizza oven into the spot.” He said the business will mirror a second location the operator runs in Burlington.
Council discussion focused on operating hours, pest control and exterior trash. Councilor D'Amamba said the council would set the hours at 10 a.m. to 10 p.m., seven days a week, and required the petitioner and the building owner, identified in council remarks as McSheffrey, to take responsibility for rodent control and exterior trash receptacles. D'Amamba also asked that pest control use an anticoagulant rather than a rodenticide to reduce risk to neighborhood animals.
A motion to suspend the rules to allow the petitioner to speak passed, and the council then voted to grant the minor modification with the three additional conditions. The vote was voice; the chair announced the motion passed.
The council wished the petitioner luck as the business moves forward.
The decision updates an existing special-permit condition to reflect the new operator and hours and imposes ongoing site-maintenance responsibilities on the operator and building owner.
