Beth Figueroa presented the petition and said the operator has partnered with the ACE Foundation to support board development, facility identification and leader recruitment.
“State law allows for a 1 year delay in a school's opening but any further delays would require authorizer approval,” Figueroa told the committee as she described the materials and proposed timeline submitted by the operator.
Staff review and recommendation: commission staff said they reviewed the operator’s timeline and milestones, met regularly with the governing board, and believe the additional year would provide time to complete critical preopening tasks. Staff recommended the committee forward the petition to the full commission for consideration, with clear expectations that the operator be held to the timelines and that corrective action could follow if milestones are missed.
Rules committee action and policy development: the commission’s general counsel, Ashley Thomas, presented draft edits to Commission Policy 3.1 to set parameters for petitions to delay opening beyond the statutory one‑year option. During the rules committee discussion members proposed two amendments that staff will incorporate before final reading: 1) require an authorized representative of the operator to appear before the commission when seeking any delay beyond the statutory one‑year option, and 2) limit commission consideration of further delay to a single additional year beyond the statutory delay except in exigent circumstances (force‑majeure/acts of God). Thomas said the language is a first reading and staff will return a redline in March.
Committee action: the SPA committee voted to forward the operator’s petition to the full commission for consideration. The rules committee added the described amendments to its draft of Policy 3.1 and voted to advance the policy on first reading for further refinement.
