Committee advances farmland conservation easement program; homestead protection bill held for amendment

Representative Culp introduced House Bill 1234, which would create an agricultural land protection program and allow willing farmland owners to donate or convey conservation easements to the Indiana State Department of Agriculture or to qualified land trusts. "This bill creates a framework for willing farmland owners to donate their conservation easements, if they choose to protect their farms for future generations to utilize to grow food," Culp told the committee.
The committee heard support testimony from conservation and farm groups. Chris Reynolds, Midwest regional director for American Farmland Trust, said HB 1234 would allow Indiana to "accept, to purchase or accept donations of Ag conservation easements" and noted similar programs already operate in 29 other states. "This bill simply provides landowners with the tools to protect their land if they believe it is the right option for them," Reynolds said.
Caitlin Smith of the Indiana Farm Bureau urged the committee to adopt the bill, calling it "another tool in the toolbox to help preserve and permanently protect ag land utilized for crop and livestock production across the state." Quentin Hayes, legislative director for the Indiana State Department of Agriculture (ISDA), testified the department released an inventory in July 2023 showing roughly 345,000 acres lost between 2010 and 2022 and said ISDA could implement the program "if we were provided some additional staffing and resources."
