Westminster approves $3,000 platinum sponsorship for Midway City Sanitary District open house; legal counsel says councilors may vote

Westminster’s City Council voted 4-0 on Jan. 22 to approve a $3,000 platinum sponsorship for the Midway City Sanitary District (MCSD) open house scheduled Jan. 25.
Vice Mayor Manzo moved the sponsorship after a short discussion in which Council members noted the collaborative relationship between the city and MCSD. Council Member Mark Nguyen seconded the motion and the roll call vote was unanimous.
Earlier in the meeting the city attorney advised the council that state law and Government Code guidance allow council members to serve on both the city council and the Midway Sanitary District board when the offices are not “incompatible.” The city attorney said Government Code section 1099 addresses incompatible offices and that a specific state law regarding Midway Sanitary District permits council members to serve on both bodies, meaning the offices are not automatically incompatible. The attorney added the primary remaining conflict would be salary or compensation, which the attorney said is excluded under governmental compensation rules, and that the primary objection to dual service is often one of appearance rather than legal prohibition.
Vice Mayor Manzo said MCSD has been a reliable partner that provides financial and operational support to city events; he recommended the platinum level to maintain the partnership. The motion to approve the $3,000 sponsorship passed on a 4-0 vote.
