Sutter LAFCO prioritizes Live Oak municipal service review; fire MSR progress on schedule

The Sutter Local Agency Formation Commission instructed staff to prioritize a municipal service review for the city of Live Oak and requested a cost estimate to include in its preliminary budget planning.

Mr. Libby, the commission's executive officer, told commissioners that Live Oak's last MSR was completed on "February 23, 2012" and noted the city has about 9,700 residents. "I would say it was a good time to... complete such a review," he said. Commissioners agreed that Live Oak should be a higher priority and requested staff return at the next meeting with a prioritized list of agencies and estimated costs for MSRs.

The discussion took place as part of a fiscal year 2024–25 midyear budget review. Mr. Libby said LAFCO has been conservative in expenditures so far but expects increased work in the second half of the fiscal year, citing an active schedule that includes a comprehensive fire MSR and the likelihood of one or two annexation applications in the coming months. He said the comprehensive fire MSR process has completed agency interviews, is reconvening an advisory committee of fire chiefs and is collecting financial data. Mr. Libby said he expects to receive an administrative draft of the fire MSR by late February or early March and to reconvene the advisory committee for further input before public review.

Commissioners pressed staff on statutory timing for MSRs, noting the statute calls for reviews every five years "as needed." Commissioners observed that many MSRs on the schedule date back to 2011–2012 and asked staff to prioritize reviews that bear on public safety and essential services, including reclamation and fire districts. Commissioner Elphick asked for an estimate of the cost for a Live Oak MSR; Mr. Libby said he would work with the MSR consultant to develop a cost estimate for the commission's preliminary budget in March.

No formal vote was required to direct staff on prioritization. Commissioners signaled informal consensus for the Live Oak review and for staff to return with a prioritized schedule and cost estimates at the next meeting. The commission also received an executive officer report that the fire MSR advisory committee has met and that data collection is ongoing; Mr. Libby said agency financial data had recently been delivered to the consultant.

The commission closed the item and moved on to routine reports and adjournment.
