The Henry County Fiscal Court approved a reduction in the performance bond for the Overview subdivision at its Jan. 21 meeting, voting to lower the required bond to $77,500 to cover remaining sidewalks and the final lift of blacktop.
Why it matters: performance bonds ensure developers complete site work (sidewalks, final pavement). A bond reduction releases funds to the developer while keeping a margin to guarantee completion.
Planning staff reported that only the final asphalt layer and sidewalks remain for the subdivision. The developer’s engineer had estimated $20,000 for sidewalks and $25,000 for the final blacktop; court staff said those initial figures appeared low and adjusted the blacktop estimate to $42,000 while keeping the sidewalk estimate at $20,000. Applying the county’s planning-and-zoning ordinance calculation at a 125% rate produced a recommended bond amount of $77,500.
Magistrate Brad moved the motion to approve the reduction; the motion was seconded (transcript records “2nd by 8”), the presiding officer called for the vote and the transcript records, “All in favor? Alright. Motion carries.” The court instructed staff to notify the developer that they may reduce the bond amount accordingly.
No additional conditions or amendments were recorded at the meeting.
