Plan Commission OKs minor subdivision at 13560 5th Road to create one residential lot

The Marshall County Plan Commission on Jan. 23 recommended approval of a minor subdivision at 13560 5th Road in North Township that would create one additional residential lot.
Planning staff described the parcel, Parcel No. 504217000116009, as currently zoned agricultural residential (A3) and reported the proposed new lot would measure 6.38 acres with approximately 411.65 feet of frontage on 5th Road and a proposed depth of 761.47 feet. The staff presentation said the lot meets the county’s minimum lot-frontage requirement of 50 feet and the ordinance’s 1:3 width-to-depth ratio.
The planning department recommended approval after a Technical Review Committee (TRC) review. Lydia, representing the planning department, told the commission the review found the proposal “meets the principles and standards for a minor subdivision,” and noted the parcel may require new drainage plans, easements and covenants or restrictions before final platting.
Applicants Mary Susan Husband and James Husband told the commission the split is intended to allow their daughter and her husband to build a residence after relocating from El Paso. “My daughter and her husband retired from the military…they’re moving back to this area. They were planning on building a home there,” James Husband said.
The commission opened and closed a public hearing with no speakers. A motion to approve the minor subdivision carried on roll call. The recorded roll-call responses during the vote were: “Mister Kulteis: Yes; Mister Kuyen: Yes; Missus Johnson: Yes; Mister Cox: Yes; Miss Mears: Yes; Mister Newnabaker: Yes.” The commission’s tally was 6 yes, 0 no; outcome: approved.
The staff report and TRC recommended that approval be contingent on compliance with county subdivision control rules (including Section 2.02), the Marshall County Zoning Ordinance, the county comprehensive plan and applicable state and federal requirements, including health department standards and Indiana Department of Transportation regulations for road access. Staff also advised the applicants to prepare drainage plans that respect on-site swales, ditches and drainage tile noted in the survey.
Commissioners were instructed to complete the required findings-of-fact forms and sign them after the meeting if they agreed with the staff’s findings.
If the applicants proceed, they must file primary approval/site-plan documentation with the plan director and meet any conditions identified by the county before recording a final plat or issuing building permits.
