Kern County Planning Commission approves three consent items; appeal process explained

At a meeting of the Kern County Planning Commission, commissioners voted 3-0, with two members absent, to approve three consent items including two zone changes and a conditional use permit for a proposed 80-foot wireless facility.
Staff read the consent agenda and recommended approval of all three items. The commission approved the consent agenda without discussion.
The three approved items were:
- Case 1 — Zone Change Case No. 63, MAP 99. Applicant: Jack Kasbergen (represented by Chris Mink). Location: northeast corner of Highway 58 and Old Tracy Avenue, Buttonwillow area. Request: rezone approximately 37.49 acres from A-1 to M-1PD or a more restrictive district. Staff recommendation: advise the Board of Supervisors to approve the zone change and enact the ordinance.
- Case 3 — Conditional Use Permit No. 8, MAP 203-1. Applicant: AT&T Mobility (represented by Yukon Group). Location: northwest corner of Wildflower Lane and Camilla Drive, Mettler area. Request: a conditional use permit to allow an 80-foot-tall wireless telecommunications facility, stealth-designed as a mono-eucalyptus tree, with an associated equipment shelter within an 810-square-foot lease area on an approximately 10-acre parcel in an R-1 zone. Staff recommendation: approve the conditional use permit with the recommended conditions and findings.
- Case 4 — Zone Change Case Nos. 26 (MAP 165-13) and 43 (MAP 166). Applicant: Evan Gardner. Locations (Tehachapi area): Parcel A — approximately 9,147 square feet, located 260 feet north of Country Club Drive on the west side of Fairway Court; Parcel B — approximately 8,712 square feet, located 350 feet north of Meadows Road at the terminus of Viquero Drive. Request: rezone both noncontiguous parcels from R-1 to OS or a more restrictive district. Staff recommendation: advise the Board of Supervisors to approve the zone changes and enact the ordinances.
Miss Slayton, Planning staff, read the consent items into the record. A commissioner moved to approve the consent agenda "as read into the record," and another commissioner seconded; an onscreen vote recorded three ayes and two members absent, and the motion carried.
Planning staff also advised the commission that Case 3 (the AT&T conditional use permit) is final as decided by the commission and is subject to appeal to the Kern County Board of Supervisors by any interested person. The staff statement specified the appeal must be filed with the Kern County Planning and Natural Resources Department at 27100 N Street, Suite 100, Bakersfield, accompanied by a $562 filing fee on forms available from the department or its website, and must be received within 14 days (including the date of the hearing).
There were no public speakers on the consent items. The meeting then proceeded to other agenda business and was later adjourned.
