Representative Hall urged approval of HB 146, which updates Utah code to remove the state’s existing dense-breast notification language and defer to the Food and Drug Administration’s federally required mammography notification.
"For years, Utah has required mammography providers to share a notification with patients who have dense breast tissue," Hall said. He told the committee the federal FDA language, adopted in September, is broader than the state statute because it requires a notification whether or not a patient has dense tissue; the bill removes the duplicative state language so providers are not required to use two different statements.
Hall said the Department of Health and Human Services reviewed options and that providers are already using the FDA statement; he also noted the statutory language could be reintroduced later if federal rules change. There was no public testimony recorded and no amendments offered. Representative Tyler Clancy moved to recommend the bill favorably; the committee approved the motion by voice vote.
Sponsor Hall said he would pay continued attention to the issue; he noted a personal stake, saying, "I lost my mom to breast cancer," while urging vigilance about how federal rules evolve. The bill now moves from committee with a favorable recommendation.
