Glendale council adopts resolution to begin vacation of public right of way near Good Hope property

The City of Glendale Common Council adopted a resolution initiating the discontinuance (vacation) of a public right of way near properties leading to the Good Hope area. The resolution establishes the statutory notice period required before the city may consider a final vacation.
City staff said the resolution triggers the required class 3 notice and a 40-day advance notice period that begins the vacation process. “I think the important thing is tonight is just the preliminary first step, which is giving a notice essentially,” a staff member said.
Staff and City Attorney Nathan Baer described how the vacation will change ownership and the intended development outcome. Baer explained how abandoned rights-of-way typically revert: “It either reverts to equally on either side, or if you can trace back, to how it was originally divided up, it goes to that specific property.” Staff said the developer in this case obtained reversion rights from a neighboring property owner and that a certified survey map combining adjacent lots has been prepared; if the vacation is completed, the abandoned area would become part of a single larger parcel.
Council members had an opportunity to view GIS maps during the presentation. The council voted to adopt the resolution on a motion by Alderman Doherty, seconded by Alderman Bailey. The resolution passed by voice vote; the resolution begins a 40-day statutory notice period and the matter will return for formal action after that period.

Staff said that if the current developer does not complete the planned development, the abandoned area would likely remain as grass until another developer seeks to build, at which point the city could require conveyance of any necessary public roads back to the city as part of an agreement.
