Council hears city attorney: group home near Clinton Elementary fits general character of R-2 zoning

City staff told the Clinton City Council that a group home operating next to Clinton Elementary is not excluded under the city’s R-2 (medium-density residential) zoning and, based on advice from the city attorney, the facility’s use aligns with the general character allowed in R-2 districts.

Council members asked staff for an update after earlier public concern that the property housed a halfway house for people released from prison. Staff said the operator described the facility as a transitional independent-living program for people recovering from drug addiction and that it is affiliated with New Hope Mental Institute in Knoxville. The city attorney reviewed the facts and advised the council that while “group homes” are not explicitly listed as a permitted use, the proposed use falls within the general character of R-2 zones, which allow higher-density residential development and a range of residential-support uses.

Staff also advised the council that the city cannot retroactively zone out an existing lawful use after it has been established. Council members heard that the facility is intended to provide transitional living as residents move from inpatient care toward independent community living.

The council directed staff to continue coordinating with the city attorney and to rely on the attorney’s opinion as staff engages with neighbors and other stakeholders. No regulatory penalties or enforcement actions were announced at the meeting.
