House passes bill to align state Medicaid third-party liability rules with federal law

The Colorado House of Representatives on 2025-01-22 passed House Bill 1033 on second reading to update state Medicaid third-party liability rules and ensure compliance with recent federal requirements.
Representative Leader, presenting the bill, said Congress added two requirements to state Medicaid third-party liability provisions in the Consolidated Appropriations Act of 2022 and this bill will ensure "the Department of Health Care Policy and Financing is in compliance with federal law and the direction given to it by the Centers For Medicare and Medicaid." He directed members to a fact sheet on the desks that summarized the changes.
Representative Garcia Sander said the bill will help hold commercial payers accountable for roughly 10% of Medicaid members who also have commercial coverage and who use Medicaid as a payer of last resort. "This bill will hold commercial payers accountable for their fiscal responsibility for the approximately 10% of Medicaid members who are also enrolled in a commercial health insurance plan," she said.
There was no floor debate recorded beyond sponsor remarks, and the presiding officer announced the bill passed after a voice vote.
The committee of the whole recommended placing the bill on the calendar for third reading and final passage.
