Applicant withdraws rezoning request for 0 East Woodbury Avenue

At its January 2025 meeting the East Point Planning and Zoning Commission accepted an applicant'requested withdrawal of rezoning case P2024RZ-001-12 for property listed as 0 East Woodbury Avenue. The applicant on the file is Cody Snyder.

The commission opened a public hearing as required because the withdrawal occurred after the item was advertised. Attorney Wiggins advised the commission that the hearing should be opened, the presence of any speakers noted, and the hearing closed before the commission acted on the withdrawal. Director Smith told the commission staff supports honoring the applicant'requested withdrawal and said the applicant has submitted a new application that "will be coming back to this body next month."

Commissioners moved to accept the withdrawal; the motion was seconded and the chair called for the ayes. The commission recorded no formal objections and the motion passed, withdrawing case P2024RZ-001-12 from the docket. No policy change or rezoning took effect because the case was withdrawn rather than decided on the merits.

Why it matters: Rezoning applications that are withdrawn after public notice postpone any decision on land-use changes and restart parts of the public-notice process when a new application is filed. According to staff, the applicant intends to re-file a revised application next month, which will again require public notice and a hearing before the commission.
