The St. Cloud Planning Commission recommended approval of an ordinance to contract city boundaries by removing two parcels mistakenly included in a prior annexation near LaSalle Avenue. Staff said the action corrects a scrivener’s error and will return the two parcels to unincorporated Osceola County; the commission voted 4-0 to recommend the change to the City Council.
Ralph Keith, an associate planner with the Community Development Department, told the commission the case before the body "is for a contraction and annexation for the project known as LaSalle Ave." He said the city is correcting an earlier action that included parcels without the owners’ consent and invoked Florida Statute 171.0501 in explaining the process: "Per Florida State statute 171.0501, orders number 202501 will amend the municipality's boundaries to remove the index parcels from the city's jurisdiction, they returned into unincorporated Osceola County."
Staff said the removal corrects an erroneous legal description that had included two additional parcels in an earlier ordinance. An outside practitioner who identified the situation as uncommon told the commission the parcels’ owners did not wish to be annexed; staff told the commission it had confirmed that one owner had been contacted and that the city believes the affected properties did not file for or consent to voluntary annexation.
The commission discussed the correction and then moved to recommend approval of the staff proposal to contract the annexation shown in Ordinance 2025-01 (annexation case AX23-00005). A motion to recommend approval was seconded and passed 4-0. The mover and seconder are not named in the transcript.
The staff report states the parcel originally intended for annexation (depicted in red in staff slides) will remain within city limits while the two erroneously included parcels (depicted in blue in the slides) will be removed. Staff will forward the commission’s recommendation and the ordinance to the City Council for final action.
