Commissioners request litigation tracking and staff say Yelm trail MOU work is underway
Summary
Commissioners asked staff for regular, brief reporting on significant tort claims and lawsuits so board members avoid inadvertently engaging matters in active litigation; staff also said public works is working on a requested memorandum of understanding with the city of Yelm for trail maintenance and will return with a proposal.

During commissioner items at the Jan. 22 work session, several commissioners raised two operational items: a request for a regular briefing on significant pending litigation and an update on a maintenance/MOU request from the city of Yelm regarding county trails.
Multiple commissioners said they had encountered constituents or cases without knowing litigation was pending and asked for a concise, recurring report (monthly or quarterly) that flags significant claims or lawsuits. Commissioners emphasized they do not need details of every small tort claim (for example, mailbox or pothole damage), but want a thumbnail list of higher‑impact matters with status indicators so they can avoid unintentionally interfering with pending legal matters or creating ex parte communication risks. County staff acknowledged the sensitivity of pending litigation but said the information is publicly available and that they will coordinate with Risk and the county attorney’s office to assemble a suitable dashboard or brief report for the board.
On the Yelm trail request, commissioners said Mayor Joe DePinto had asked the county to consider a maintenance arrangement or MOU that would allow the city to maintain parts of a trail system. County staff reported that public works has met with city staff, that an official request and a point person from Yelm have been established, and that staff will return to a future work session with the background and proposed next steps. The county manager said public works would prepare an implementation approach and bring it back to the board within weeks.
Commissioners and staff also discussed constituent coordination and the county’s internal tracking of requests and follow‑ups; staff said constituent request tracking exists and could be refined so commissioners can see whether a particular issue has been received and who is coordinating the response.
