Plan Commission approves Spring Street CSM with added note defining conservation easement

The Plan Commission voted Wednesday to recommend approval of a certified survey map for 13117 Spring Street, with conditions that the applicant enter a development agreement for required improvements, add RM2 zoning information to the map where applicable, and provide a cross-access easement from Carrington Boulevard to Rosewood Lane before recording.

Planning staff said the CSM consolidates two parcels, dedicates a portion of right-of-way for Carrington Boulevard, and parcels a remaining area as Lot 2; the map shows environmental corridors that the applicant proposes to protect via a conservation easement. Staff noted the proposed configuration complies with block-length provisions because the environmental corridor preserves open space and renders a north–south roadway infeasible in that location.

Staff also provided a fiscal analysis that estimated combined property value projections would cover the long-term infrastructure and service expenses related to Carrington Boulevard; staff noted part of the subject property lies within Tax Increment District 7, which may affect incentives. Commissioners discussed title and timing concerns, urging that cross-access easement language be placed on the CSM where possible so the connectivity obligation appears in title records. "I think that would be a courtesy to us," one commissioner said.

Commissioners asked for clearer language specifying what the conservation easement prohibits and allows; staff said the village’s code already restricts construction and dredging in wetlands and suggested adding a note clarifying allowed maintenance actions such as removal of invasive species. Nancy, a commissioner, moved approval with an added note better defining the wetland conservation area; the motion passed by voice vote.

Conditions must be satisfied before the CSM is recorded; staff said most applications expire one year from submittal if conditions are not met.
