Council delays final sale of Colima addition streets, directs follow-up on Avenue C

The Alpine City Council on the second reading approved an ordinance to allow the sale of unimproved portions of Saltillo, Monterey, Toluca, Morelos and other small street segments in the Colima addition to applicants Michael and Lynn McCarson, but amended the action to require staff follow-up about Avenue C.
The council considered Ordinance 2024-11-1, described in the meeting packet as authorizing the vacation, abandonment and sale of unimproved portions of several streets in blocks 1–6 of the Colima addition and authorizing the city manager to execute a deed without warranty and deposit proceeds into the general fund for street maintenance. A councilmember moved to approve the second and final reading and the motion carried as amended after extended discussion about access and future development.
Councilmembers raised concerns that selling the city-owned street segments without preserving sufficient ingress and egress could reduce long-term value and complicate access for the deep, half-acre lots in the area. Several members asked staff to clarify whether retaining the full width of Avenue C — rather than a smaller alley — was feasible and whether utility access would be affected. “My preference would be to retain the entirety of Avenue C,” one councilmember said during the debate, citing safety and future development access.
After discussion the council amended the motion: the council voted unanimously to postpone final administrative steps as needed and directed the city manager to meet with the applicant — referred to in the meeting as Mr. McCarson — to discuss retaining Avenue C and clarify utility and ingress/egress implications. The city secretary announced the council “disposed of the original motion as written, and it has been approved as amended.”
The city manager told council staff have not completed a utility easement assessment for the parcel and recommended additional research before finalizing any permanent transfers of city property. Council members agreed the city should seek clarity about whether the appraised sale price would be adjusted if a segment such as Avenue C were excluded from the transfer.
The action preserves the applicant’s ability to continue with a replat in the future but adds a required staff conversation with the buyer about the retained street section. The council instructed staff to report back with the results of that discussion at a future meeting.
