Brownsville city commissioners on Jan. 21 approved eight digital billboard applications with conditions drawn from a city-commissioned lighting study and consultant recommendations.
The commission required applicants to meet Illuminating Engineering Society (IES) luminance targets for the city'designated lighting zones, to install automatic photo-sensor controls (``dusk-to-dawn''/ambient-light sensors), and to provide manufacturer documentation and local contact information for sign operation and troubleshooting. The commission asked staff to finalize an enforcement procedure that uses a certified luminance meter to verify compliance and to propose a fine schedule for any violations.
Consultant Dan Kos of Friesen Nichols led the technical presentation and demonstration. He explained the metric the city will use, saying, "For lighting zone 3, that sign should produce 80 candelas per meter squared," and described on-site testing that calibrated an example sign to the IES-recommended output. Kos told commissioners the consultant tested sign outputs at multiple power settings and that some signs' factory defaults were substantially brighter than the recommended night-time settings.
During public comment, Michael Rios, a representative for a sign operator, said applicants can configure equipment to meet the requirements: "Our signs are capable of being shipped with a device that would direct light in any direction we would like it." Another speaker, business owner Ernie Hernandez, described modern digital billboards and the companies that operate them, and said operators are able to program automated brightness control.
City staff outlined the proposed application and review checklist: site plan and zoning within 500 feet, sign plans and elevations, photocell/photo-sensor control details, and a contact for the controlling company. The consultant recommended the city acquire a certified luminance meter and train staff to perform spot checks; commissioners indicated they expect enforcement to be largely complaint-driven but supported periodic or random inspections.
The commission'motion to approve the eight listed applications included a requirement that any outstanding technical documentation be supplied and that the signs operate to meet the consultant'recommended IES luminance levels for the applicable lighting zone. The motion passed with unanimous voice votes.
The commission also directed staff to return with a proposed administrative procedure for: (1) certifying applicant-supplied luminance evidence, (2) field verification steps, and (3) a recommended fine schedule for violations.
Why it matters: Digital billboards have raised concerns from residents about nighttime glare and visual clutter; the adopted conditions set an enforceable technical standard and a path for local verification and compliance.
