Troy council adopts emergency resolution backing OML challenge to AT&T tariff

Troy City Council on Jan. 21 adopted an emergency resolution, R3-2025, endorsing the Ohio Municipal League’s (OML) challenge to an AT&T tariff petition at the Public Utilities Commission of Ohio (PUCO).
The Committee on Partnerships reported that if PUCO grants AT&T’s tariff, “other utilities could make the same filing,” and municipalities could become responsible for relocation and undergrounding costs now typically absorbed by utilities. That committee recommended emergency legislation authorizing Troy to join OML’s challenge. Mrs. Marshall, chair of the Committee on Partnerships, read the committee’s recommendation during the council’s committee reports.
Council members moved to suspend the rules and adopt R3-2025 on Jan. 21. The motion to suspend the rules was made by Mr. Witten and seconded by Mr. Phillips; the subsequent motion to adopt the resolution was made by Mr. Witten and seconded by Mr. Twist. The roll call on adoption recorded all present council members voting yes; two members were recorded as excused earlier in the meeting.
Council discussion and public comment earlier in the meeting included an update that AT&T had temporarily withdrawn its petition to PUCO and indicated it would file a revised petition in early 2025. A committee speaker summarized that AT&T withdrew the December filing to refine it but warned the company planned to return with a revised request, reinforcing the committee’s recommendation that Troy prepare emergency legislation to join OML’s opposition.
The resolution directs the city to support OML’s legal and administrative efforts at PUCO; it was adopted as an emergency resolution so the city’s support can be filed promptly if the tariff is refiled.
The council did not adopt any ordinance language that would itself require payments; the resolution is a statement of support for OML’s challenge and requests preparation of related legislation and administrative participation.
