Planning Commission backs favorable rezoning recommendation for proposed gas station

The Jefferson County Special Planning Commission voted on Jan. 21 to forward a favorable recommendation to the Jefferson County Commissioners for a zoning map change that would allow a gas station on roughly 2 acres along the highway.

The commission’s recommendation is advisory; the County Commissioners will make the final decision. Commissioners considered the proposal against the Jefferson County comprehensive plan and other local factors, and discussed public notice, site context and conflicts of interest before voting.

At the start of the agenda item commissioners noted that five affirmative votes are required for the commission to take action and that one member, David Ferguson, was expected to recuse himself from the matter. A commissioner who visited the site said the parcel sits adjacent to an existing business on one side, a mobile home park across the way and other commercial properties on the same corridor. The speaker said the project would remove about 2 acres of farm ground from an existing field and, from that site visit, did not see a conflict with the character of surrounding uses.

Staff confirmed that notice (green cards) was mailed to adjoining landowners. Commissioners said the green cards had been sent in an earlier mailing and a second mailing expanded the list to reflect the parcel before a recent division; commissioners reported no written comments or emails had been received from adjoining landowners.

With a motion for a favorable recommendation seconded by another commissioner, the body conducted a roll-call vote (excluding the member who was recused). Members voting in favor included Warren Ochsher, David (last name varied in the transcript), Mike Pittman, Jenny Beverly, Lisa Hammock and Ray Black. Fred Copeland was not present. The commission chair announced that the motion had the required affirmative votes and that the commission would forward a favorable recommendation to the County Commissioners.

Following the vote, commissioners discussed next steps for placing the item on the commissioners’ agenda. A commissioner asked whether the County Commissioners’ meeting required a public hearing notice for the item; staff indicated the item would appear under the commissioners’ agenda and that it was not a public hearing. A commissioner also asked staff to check notice requirements and to coordinate with county administrative staff so the item could be scheduled.

Other business

A brief update from the county’s Solar Technical Committee followed. Commissioners said most less-controversial technical issues had reached conclusions, but the committee has not reached consensus on limits such as maximum acreage or required distances between solar facilities. The commission said it will hold one more technical committee meeting and solicit additional public input; remaining acreage- and distance-related policy decisions are expected to be left to the Planning Commission when the committee’s product is brought back for review and a subsequent public hearing.

The commission will forward its recommendation to the Jefferson County Commissioners for final action. Staff was asked to confirm notice requirements for the commissioners’ agenda and to work with county administrative staff on scheduling.
