At the Jan. 21 meeting the Selma City Council voted to add the proposed contract and resolution for city attorney Costanzo to the consent calendar and to add four closed-session items for consideration at the end of the meeting.
City Attorney Costanzo had requested multiple additions to the agenda: closed-session items concerning public employment (all positions/departments), pending litigation (City of Selma v. Second Chance Animal Shelter, Fresno County Superior Court case 24 CECG04247), exposure to potential litigation (one case), and a conference with real-property negotiators involving 1445 Nebraska Avenue (Sun Maid Raisin Company as a potential buyer represented by brokers). Costanzo said adding the items required a four-fifths vote because they were added after the agenda was posted.
The council voted to add those items to the closed session. They also voted to include Costanzo's proposed city-attorney contract on the consent calendar. Councilmember Trujillo raised a conflict-of-interest concern about Costanzo previously representing parties in litigation related to the city before authorizing him to represent the city on pending matters; Costanzo said he could address that in closed session.
Votes: The 4/5 vote to add the items passed according to the roll call; later the council approved adding the attorney contract to consent by roll call.
