The city attorney read the closed-session item into the record as being considered “pursuant to Government Code section 54956.9(e)(3), which is a claim or other written communication threatening litigation,” and said any reportable action would be announced at the beginning of the regular session. At the regular session the attorney reported, “the closed session, the council voted 5 to 0 to reject the claim, and the city will be providing notice of that rejection to the claimant.”
The council recessed to closed session at about 5:31 p.m. and returned at about 6:30 p.m. The attorney did not identify the claimant or the subject matter of the threatened litigation during the open session report.
No further action or direction to staff was reported in the public portion of the meeting beyond the notice of rejection and the statement that the city will provide notice to the claimant.
