Zoning hearing officer approves nonconforming-use permit to alter garage at 124 Fay Drive

Zoning Hearing Officer Joe LeClaire approved a nonconforming-use permit Thursday to enlarge and reorient an existing detached two-car garage at 124 Fay Drive in the Burlingate Hills neighborhood (File PLN 2024-00197, APN 027-073-080).
LeClaire said the application was approved “subject pursuant to the findings and subject to the conditions of approval in Attachment A.” The hearing officer also noted the project is listed on the consent calendar and that staff had recommended approval.
The application lists Randall Kohn and David and Sonia Ivester as owners and Ellis Choquette as the applicant. During the meeting the applicant (unnamed in the record) indicated agreement with the staff report and conditions, saying, “Yes. I’ve never read it and I agree.”
Staff cited a categorical exemption under the California Environmental Quality Act (CEQA) in the staff materials. LeClaire advised that anyone wishing to appeal the decision must submit a written appeal application to the Planning and Building Department and pay a new appeal fee of $1,962; the appeal application must be received by Jan. 31, 2025.
No public testimony on the item was recorded and the hearing officer closed the matter on the consent calendar. The approval is effective pending any timely appeal filed under the department’s procedures.
