Nueces County approves bylaws and chief public defender posting for TIDC‑funded office

Nueces County Commissioners Court approved bylaws for a new public defender oversight committee and authorized creation and posting of a chief public defender position July 29, to implement a Texas Indigent Defense Commission (TIDC) grant.
County staff and members of the oversight committee told the court the TIDC funding and associated deadlines require the county to finalize bylaws and post for a chief public defender so the program can begin hiring and take over public‑defense coverage in early 2023. Committee members participating by phone said TIDC has already approved the bylaws draft and requires county approval to move forward with the hire.
Commissioner discussion focused on committee composition. One commissioner objected to language that appeared to reserve a seat on the oversight committee for a member of the commissioners court because the court had earlier voted not to serve on the board. Court members agreed to amend the bylaws: rather than giving a commissioner a seat, the court added a slot for the county manager or the manager’s staff designee. The court then approved the bylaws with that amendment.
After a short procedural pause (the bylaws had briefly been approved and then a motion to reconsider was made), the court again voted to approve the bylaws with the manager/designee amendment. The court also voted to create the chief public defender position (pay group 47 under the county pay scale) and to post the job; staff said the first year of the position would be 100% funded by the TIDC ARPA grant and that TIDC had reviewed and approved the proposed pay group level.
Oversight‑committee members, judges and criminal‑defense stakeholders attending the meeting described the steps as required to meet TIDC deadlines and to allow the committee to hire a chief public defender and subsequently staff the office. County staff said TIDC expects a chief hired by roughly Oct. 1 so the office can be operational for the 2023 calendar year.
Ending: County staff were directed to provide the court with the signed letter of acceptance for the grant and to coordinate with the oversight committee on the recruitment process. The bylaws and job posting move the county toward implementing the TIDC grant; further policy and staffing decisions will be made by the oversight committee and the court as the program develops.
