The Agency of Agriculture briefed a legislative committee on ongoing water-quality work tied to the 10th anniversary of the Significant Water Quality Act (Act 64), saying agriculture has been a central contributor to phosphorus reductions in Lake Champlain while noting the regulatory and enforcement tools the state uses.
The agency emphasized the scale of its farm outreach and investment. "So today, we're gonna spend a little time talking about water quality," the committee chair said, opening the presentation. Laura DiPietro, a presenter from the Agency of Agriculture, reviewed technical assistance, capital projects and the agency’s regulatory approach.
The briefing summarized recent activity and resources the agency said are focused on reducing phosphorus from farms. The agency reported 1,274 technical visits to farms in 2024, 101 outreach events that year, roughly 558 clean-water projects funded, and 334 regulatory inspections and assessments. DiPietro said the department invested state dollars in capital and program support and identified a recurring pattern: agricultural practices have delivered a disproportionate share of phosphorus reductions compared with their share of the water-quality budget.
DiPietro told the committee that, according to agency analysis, agricultural measures account for about 90% of observed phosphorus reductions attributed to agriculture, that agriculture has achieved about 33% of the reductions needed in its sector under the Lake Champlain Basin total maximum daily load (TMDL), and that agriculture represents roughly 24% of the state’s water-quality budget while delivering about 77% of statewide phosphorus reductions credited to agricultural work.
The agency described a mix of programs it runs or funds: cost-share capital projects (state dollars matched by farmers and federal funds), per-acre payments, longer-term contracts (typically 10–15 years) for structural practices, and pilot payments for performance such as paying per pound of phosphorus reduced. DiPietro showed photos of constructed manure-handling systems, riparian forest buffers, managed grazing improvements and filter strips as examples.
On enforcement and permits, the agency explained how state rules fit with federal programs. DiPietro described the state’s medium-farm and large-farm permit programs and the federal concentrated animal feeding operation (CAFO) permit that is administered by the Agency of Natural Resources (ANR) at the state level. She said Vermont has not issued any federal CAFO permits to date, that the agency currently holds 97 medium-farm permits and 36 large-farm permits, and that inspection cycles are set at a minimum of every three years for medium farms and annually for large farms.
DiPietro said the agency performs more frequent inspections in practice because of complaint follow-ups and recurring visits. She said the agency coordinates with ANR and the Vermont attorney general’s office under memoranda of understanding: the agency inspects and manages nonpoint-source issues and refers potential direct discharges to ANR and, when significant, to the attorney general.
Committee members asked about how phosphorus targets and TMDL numbers are set. DiPietro said the Lake Champlain TMDL was developed by the U.S. Environmental Protection Agency with contractor support and long-term water-sampling records for the lake, and that modeling and sector estimates are used to set reduction targets. "The TMDL was done in for Lake Champlain by EPA," she said, describing the modeling process and long-term monitoring that underpins the targets.
The presenter also demonstrated a public data portal the agency published, which the agency said lets users explore basin- and county-level investment, technical visits, regulatory assessments, acres of practices installed and estimated phosphorus reductions. DiPietro invited committee members to use the dashboard to view local numbers and program summaries.
No formal votes or motions were recorded during the presentation.
The committee and agency agreed to continue questions and follow-up; DiPietro offered the agency’s "open door" for further data requests and in-person briefings.
