The Board of Zoning Appeals approved a variance to reduce accessory-structure setbacks for a detached storage shed at 324 Andy Johns Drive, finding the lot’s unusual shape and front-setback requirements create a practical hardship.
Planning staff told the board the R-3 property measures about 13,353 square feet and that the municipal ordinance requires an 8-foot rear and side setback for detached accessory structures. The applicant asked to place the shed approximately 3 feet from the rear and side lines, a 5-foot variance from the ordinance. Staff said rotating the shed to meet the 8-foot setbacks would place it near the concrete patio or within 2 feet of the dwelling and that the requested location behind the house—and planned 7-foot vinyl privacy fence—would limit public visibility.
During the public hearing, homeowner John Armstead said the shed will be a premanufactured unit and that he plans to match the house’s appearance and install a vinyl fence. He said he had signatures from two neighbors who would be affected and that he did not intend to create an eyesore.
Staff applied the variance criteria in Section 7.080(d) and recommended approval, noting the lot’s corner/curved-front configuration and prior similar variances in the district. The board voted to approve the setback variance; the motion carried by voice vote.
