ZBA approves deck variance in Deer Park; owner agrees deck remain unenclosed

The Town of Babylon Zoning Board of Appeals approved application 24256 to maintain a rear-yard deck at a Deer Park property, increasing the building-area allowance from 20% to 24.73%, with a condition that the deck not be enclosed.
Christine Faye of Accurate Expediting represented the applicants, Robert and Arlene Flats. Faye told the board the request was to legalize the deck and that the applicants agreed the deck would not be enclosed and would not be further expanded. The board noted the planning division and environmental control memos (Jan. 8 and Jan. 14, 2025) had no objection and that photographs and a survey were submitted.
A motion to approve application 24256 with the condition that the deck remain unenclosed passed on a voice vote. The board recorded that the owners said they plan to sell the house in the future and agreed to no further expansions. The ZBA will issue a written decision to the applicants, and any required building permits must be obtained before alterations proceed.
