Jefferson, Scott counties approve interlocal agreement to share chip-and-seal equipment

Jefferson County Council voted to adopt an amended interlocal agreement with Scott County that lets the two counties jointly purchase and operate chip-and-seal road maintenance equipment, the council said during its January meeting in Madison.
The agreement, which the council read into the record and approved by voice vote, says each county will equally share the initial purchase costs, manage scheduling through their highway superintendents, and use the equipment seasonally between May 1 and Oct. 30. Each county will retain ownership of equipment it purchases, carry insurance for its own machines, and store equipment in the Jefferson County garage during the off-season.
The interlocal cites Indiana Code 36-1-7-2 as authority for counties to enter joint agreements and references public purchasing requirements and applicable federal laws for equipment procurement. It requires that each county charge FEMA rates for labor and equipment when assisting the other and preserves an option for a county to buy out the other party’s interest if the agreement ends.
The agreement includes standard contract provisions: a term through Dec. 31, 2025, procedures for extension by written agreement, indemnification language, nonbinding mediation for disputes, severability, and a requirement that the signed agreement be filed with both counties' recorders within 60 days.
Council members who moved and seconded the motion did not record individual roll-call tallies in the minutes; the motion carried on a voice vote.
The council flagged procurement compliance with Indiana public purchasing law and said any required public bids will be followed. The text also states that partial or complete termination will be handled under Indiana Code 36-1-7-3 and that the agreement may be amended only by written consent of both parties.
