Commissioners consider extending sidewalk bond for Mount Vernon Manor subdivision rather than collecting guarantee

Hall County staff presented a request to collect a $187,250 performance and maintenance guarantee for uninstalled sidewalks in the Mount Vernon Manor 22-lot subdivision. The bond was set because the final plat required a 5-foot sidewalk along one side of the internal roadway; staff said the sidewalks were not constructed following the January 2023 platting.
Bill Nash (staff) said the bond is scheduled to expire in January 2026 and that the county was notified the developer submitted a waiver of the sidewalk requirement; that waiver would not be heard until March. Commissioners discussed whether the county should cash the bond and construct the sidewalks or first ask the developer to extend the bond to avoid the county installing sidewalks only to have them removed later for driveways and site work.
Several commissioners expressed a preference to seek an extension from the developer before collecting the bond; one commissioner noted the county would incur costs to install sidewalks now and risk replacing them when driveways are added. Nash said staff would contact the developer and attempt to secure an extension or amended bond and report back at the Thursday voting meeting.
