Josh Heagy, representing Blue Ridge Ag LLC, returned for a first workshop asking the Madison County Planning Commission to restore the full set of by-right B-1 uses that were proffered away in a 2023 conditional rezoning approval.
Staff reported that the March 2023 approval had retained only a narrow set of B-1 uses while several others were proffered away. Heagy told commissioners his business needs have changed and that restoring by-right uses would allow operational flexibility for sales, storage and related activities he said the business now requires.
Commissioners discussed which B-1 uses the applicant actually needs and whether restoring all by-right uses without limitation is appropriate in the parcel's context. Several commissioners urged Heagy to work with staff to identify a narrower set of allowed uses (or targeted proffers) reflecting the actual commercial intent instead of removing all conditions wholesale. Commissioners also asked about the previous proffers concerning paving of a driveway and whether that requirement should remain if traffic increases.
Staff said the application is a starting point for discussion; no vote was taken. Commissioners suggested the applicant and staff draft options—either a full restoration or a limited set of restored uses tied to proffers covering access, parking, drainage and any required VDOT approvals—before a public hearing.
Ending: The planning commission encouraged the applicant to work with staff to narrow the requested change or to propose new proffers that address driveway paving, access and compatible uses for the Seminole Trail location.
